Medicann Terms and Conditions

Welcome to Medicann, trading as Medicann (Jersey) Limited (Jersey, company number: 116256), Medicann (Guernsey) Limited (Guernsey company number CMP68085), Medicann (IOM) Limited (Isle of Man, company number: 019128V), and Medicann UK Limited (trading under Medcann (Scotland) Limited, company number: SC842768 ) ('the Clinic,' 'we,' 'us,' or 'our').These Terms and Conditions ('Terms') govern access to and use of services, including medical consultations, treatment plans, and access to medical cannabis, in accordance with the applicable laws of the United Kingdom, Jersey, Guernsey, and the Isle of Man (collectively, 'the Territories').


Eligibility for Services

To be eligible for the services, individuals must:

  • Be at least 21 years of age.
  • Possess legal residency status in the jurisdiction where treatment is being sought.
  • Provide valid photo identification and proof of address.
  • Have a condition that, in the professional opinion of a licensed practitioner, may benefit from medical cannabis treatment under the legal frameworks applicable in each jurisdiction, including:
  • The Misuse of Drugs Regulations 2001 (UK)
  • The Misuse of Drugs (Jersey) Law 1978
  • The Misuse of Drugs (Bailiwick of Guernsey) Law 1974
  • The Misuse of Drugs Act 1976 (Isle of Man)


Acceptance of Terms

  • By using the services, the individual confirms that they have read, understood, and agreed to these Terms and Conditions.
  • The Clinic may update these Terms at any time, and continued use of services constitutes acceptance of the revised Terms.
  • Rights and obligations under these Terms may be transferred to another organisation, with notice provided.


Consultations and Clinical Evaluation

  • All consultations are provided by medical professionals registered in the relevant jurisdiction.
  • Services are available by referral from a healthcare professional or via self-referral; however, all applications are subject to full clinical review and approval.
  • The clinicians will evaluate the individual's medical history and assess whether medical cannabis is appropriate for their condition.
  • Any recommendations made by clinicians are based on professional medical judgment and current medical cannabis regulations.
  • There is no guarantee that any clinician will issue a prescription for medical cannabis. Issuance of prescriptions is at the sole discretion of the clinician.
  • The individual acknowledges that the Clinic is bound by professional guidelines to ensure that conventional treatments or investigations are attempted before considering a prescription for medical cannabis.
  • Timeframes provided for guidance are indicative only and may vary depending on application volume, completeness of documentation, and clinical review requirements.
  • Follow-up appointments may be required at regular intervals, as determined by the prescribing clinician, to monitor treatment outcomes, reassess appropriateness, and ensure continued clinical compliance.
  • Consultations may be offered remotely via secure telemedicine platforms where permitted by jurisdictional regulations.
  • Remote consultations are conducted under the same standards of care and confidentiality as in-person appointments. Patients are responsible for ensuring access to a private, safe, and stable connection for remote consultations and understand appointments may be rescheduled if suitable environment is not established.


Prescriptions and Pharmacies

  • If the prescribing clinician finds it appropriate to issue a prescription for medical cannabis, the individual will be responsible for the cost of medications.
  • Prescriptions are valid for 28 days from the date of issue. Repeat prescriptions require clinical approval.
  • The individual understands and accepts that the Clinic will not directly provide or dispense medical cannabis but may provide a prescription to be fulfilled through an approved associate pharmacy (i.e., a licensed pharmacy working in agreement with the Clinic for safe dispensing and monitoring).
  • The individual may select their preferred pharmacy so long as the pharmacy is appropriately licenced and signed up to the Clinic system and allow safe and effective prescribing and tracking of patient treatment.
  • The individual is aware that the Clinic prescribes non-irradiated cannabis where appropriate and advises caution for immunocompromised individuals.
  • The individual gives consent for the Clinic to release their contact and prescription details to the associate pharmacy for them to contact regarding dispensing.
  • All medications are subject to EU GMP standards. Due to the plant-based nature of the product, some natural variation may occur.
  • Due to the natural origin of cannabis-based products, variation in cannabinoid and terpene profiles may occur across batches. The Clinic cannot guarantee exact consistency in therapeutic effects or strain characteristics.
  • In accordance with healthcare regulations, prescribed cannabis-based products cannot be returned or exchanged once dispensed, regardless of satisfaction or unused quantity.
  • The Clinic does not provide refunds for medication that has been dispensed, even if the individual is dissatisfied with the product.
  • The Clinic does not control or guarantee the availability, price, or delivery timelines of third-party providers.
  • The cost of medication and pharmacy services may vary across jurisdictions.
  • The Clinic and its clinicians do not receive incentives from pharmacies or product suppliers. Any potential conflicts of interest will be declared in accordance with professional and regulatory guidelines.


Delivery and Collection

  • Delivery services are available only within the United Kingdom. Delivery charges are non-refundable. If an order is delayed, returned, or cancelled after dispatch, any delivery fees paid at the time of purchase will not be reimbursed. Orders are processed on a same-day dispatch (Monday-Friday) basis; however, delivery timelines are not guaranteed. Once the parcel has been transferred to the courier, responsibility for delivery rests with the delivery provider. Any enquiries, changes, or concerns regarding delivery must be directed to the courier, as we have no control over the delivery schedule once dispatch has occurred.
  • Orders will only be dispatched to the delivery address registered with the clinic. It is the patient's responsibility to ensure that the address provided is accurate and up to date. Once dispatch has occurred, any amendments to the delivery address or delivery arrangements must be managed directly with the courier. We cannot accept responsibility for delays, failed deliveries, or losses resulting from incorrect or amended delivery information.
  • In locations where delivery is not available (Jersey, Guernsey and Isle of Man) patients may authorise a third party to collect medication in person from a dispensing pharmacy. It is the patient's responsibility to ensure that the nominated individual's details and identification remain accurate and valid with the pharmacy. By authorising a third-party collector, the patient consents to the release of their medication and the minimum necessary information required to verify the collection. We accept no responsibility for delays, failed collections, or losses arising from third-party collection. Any amendments to authorised collectors must be provided directly to the pharmacy prior to collection.


Fees, Appointments, and Cancellations

  • Appointments must be booked in advance. Fees are clearly stated at the time of booking.
  • Fees may vary across jurisdictions.
  • At least 24 hours' notice is required for cancellations or rescheduling. Missed appointments may incur a fee.
  • Refunds are not provided for services rendered or for missed appointments without sufficient notice.
  • The Clinic reserves the right to change fees, with notice provided via the website or direct communication.
  • The Clinic reserves the right to withhold all or part of the appointment fee as compensation for administration.
  • The Clinic may cancel an appointment without liability if required information is not provided in time, payment is not made, or the Terms are breached (e.g., abusive behaviour).


Medical Cannabis Use and Risks

  • The individual understands that medical cannabis is an unlicensed medication and has not been subjected to the same rigorous safety, quality, and efficacy standards as licensed medications.
  • Medical cannabis is to be used only as a last resort to improve symptoms and quality of life.
  • The individual accepts that medical cannabis may not be effective and may cause physical, mental, and cognitive side effects.
  • Side effects may occur when commencing treatment or changing doses, which may affect the ability to safely drive, cook, care for dependents, or make important decisions.
  • The individual understands the need to discuss any combinations of medical cannabis with other medications, including over-the-counter and herbal treatments, with their GP.
  • Allergic reactions are possible when using medical cannabis or its components.
  • The individual accepts that there are medical contraindications to prescribing medicinal cannabis, such as stroke, heart attacks, liver disease, and risk of psychosis.
  • Medical cannabis is contraindicated during pregnancy or breastfeeding unless specifically authorised by a specialist clinician.
  • The individual must seek immediate medical advice from the Clinic or another provider if their condition worsens or adverse effects occur.
  • For urgent concerns about medication or symptoms outside regular hours, they should contact a GP or NHS 111 (UK only) for non-emergency medical advice. In the event of a medical emergency, they should call 999.
  • The individual accepts responsibility for checking the legal limits for cannabis when driving in any jurisdiction.
  • The individual must make the DVLA and their insurance company aware of their prescription should it be required by law or by the terms and conditions of their insurance company.
  • It is the responsibility of the individual to advise their employer about their treatment should it be required under their employment terms.
  • There are some safety-critical employment roles that may no longer be suitable as a result of being prescribed medical cannabis.
  • Some employers may randomly drug test patients and there is a potential risk of termination of employment for non-compliance with occupational health processes.
  • Medical cannabis is a controlled drug. If travelling outside the prescribing jurisdiction, the individual will ensure compliance with relevant laws.
  • Transporting prescribed medical cannabis between jurisdictions (even within the British Isles) requires legal compliance with each relevant authority.
  • The individual acknowledges that use of medical cannabis may result in detectable levels of cannabinoids during drug testing, which may impact employment, insurance coverage, or legal status.


Responsibilities and Compliance

  • The individual agrees to only use medical cannabis for the treatment of their medical condition as agreed with the consultant.
  • Smoking medical cannabis is illegal. It must only be consumed with a vaporiser when prescribed in flower form.
  • Selling, sharing, or giving away medical cannabis is a criminal offence.
  • The individual understands they are responsible for complying with the laws regarding medical cannabis possession and use.
  • They must always carry proof of prescription when in possession of medical cannabis.
  • Patients have the right to confidential and respectful care, access to their own medical records upon written request, and the right to decline or discontinue treatment, provided it does not violate any legal obligations.
  • The Clinic adheres to safeguarding laws in all Territories and has a duty to act on any concern raised during interactions involving children or vulnerable adults, including reporting to appropriate authorities where required.


Data Protection and Privacy

  • The Clinic is committed to protecting personal data in accordance with applicable data protection laws, including the UK and EU GDPR and Data Protection Acts in Jersey, Guernsey, and the Isle of Man.
  • Where patient data is stored or transmitted via platforms located outside of the individual's jurisdiction (including outside the UK/EU), the Clinic ensures appropriate safeguards are in place, such as Standard Contractual Clauses or equivalent legal mechanisms.

Limitation of Liability

The Clinic is not liable for:

  • Misuse of medical cannabis.
  • Delays or issues with third-party pharmacies.
  • Product quality issues.
  • Legal issues arising from possession or use of cannabis.
  • Consequential, incidental, or indirect damages from the use of services.


Complaints Procedure

  • The Clinic will acknowledge all complaints and aim to respond within a reasonable timeframe.
  • If unresolved, complaints may be escalated to an independent regulatory body, where applicable.


Zero Tolerance Policy

The Clinic maintains a zero-tolerance policy towards abusive, threatening, or otherwise inappropriate behaviour directed at staff, clinicians, or other patients. This includes, but is not limited to, verbal abuse, harassment, discriminatory language, or aggressive conduct whether in person, over the phone, or via electronic communication. Such behaviour may result in refusal or permanent termination of services, and where appropriate, notification to regulatory bodies or law enforcement.


Force Majeure & Transfer of Rights

Services may be delayed, changed, or cancelled due to unforeseen circumstances beyond the Clinic's control, such as natural disasters, pandemics, or governmental restrictions.


Governing Law and Jurisdiction

These Terms are governed by the laws of the jurisdiction where services are delivered:

  • The United Kingdom, for services provided to UK residents.
  • Jersey, Guernsey, or the Isle of Man, as applicable.


Disputes will be subject to the exclusive jurisdiction of the courts in the relevant jurisdiction.
